Acceptance of Terms
Welcome to Open Play Finder. By accessing or using the Open Play Finder website, mobile application, or any related services (collectively, the "Platform") at openplayfinder.com, you agree to be bound by these Terms of Use ("Terms") and our Privacy Policy.
If you do not agree with any part of these Terms, you must not use the Platform. These Terms constitute a legally binding agreement between you and Open Play Finder ("we," "us," or "our").
You must be at least 13 years of age to use Open Play Finder. If you are under 18, you may only use the Platform with the involvement and consent of a parent or legal guardian.
About Open Play Finder
Open Play Finder is a free community platform that helps pickleball players discover courts, connect with other players, organize open play sessions, and explore events, coaches, and clubs. The Platform includes:
- An interactive, community-maintained map of pickleball courts with details such as amenities, surface type, lighting, peak times, and cost
- Community features including court check-ins, crowd-level signals, player reviews, photos, and tips
- Player matchmaking and open play coordination tools
- Discovery and booking tools for coaches, events, clinics, and local clubs
- Organizer tools for managing events and collecting payments
Open Play Finder is currently focused on North America, with initial coverage centered on Las Vegas, Nevada, and expanding over time.
User Accounts
Registration. Some features of the Platform require you to create a free account. When registering, you agree to provide accurate, current, and complete information and to keep that information up to date.
Account security. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@openplayfinder.com if you suspect unauthorized access to your account.
One account per person. You may not create multiple accounts or operate accounts on behalf of others without our prior written consent.
Account suspension. We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or otherwise harm the community.
User-Generated Content
Open Play Finder is a community-powered platform. Users may submit court listings, reviews, photos, tips, check-ins, player profiles, event listings, and other content ("User Content").
Your license to us. By submitting User Content, you grant Open Play Finder a non-exclusive, worldwide, royalty-free, sublicensable license to use, display, reproduce, modify, and distribute that content in connection with operating and improving the Platform.
Your representations. By submitting User Content, you represent that you have the right to share it, that it is accurate to the best of your knowledge, and that it does not violate any third-party rights or applicable laws.
Court data accuracy. Court information on the Platform is primarily contributed by the community. We do not independently verify all court listings and cannot guarantee the accuracy of hours, availability, court conditions, or other details. Always confirm conditions before heading out to play.
Content moderation. We reserve the right to review, edit, or remove any User Content that we determine, in our sole discretion, violates these Terms or is otherwise objectionable.
Acceptable Use
You agree to use the Platform only for lawful purposes and in a manner consistent with the spirit of the pickleball community. You must not:
- Submit false, misleading, or inaccurate court information or reviews
- Harass, threaten, or abuse other users
- Post spam, unsolicited advertisements, or promotional content outside designated areas
- Impersonate another person or misrepresent your affiliation with any entity
- Scrape, crawl, or harvest data from the Platform without our prior written permission
- Attempt to gain unauthorized access to any part of the Platform or its underlying systems
- Use the Platform for any commercial purpose not expressly authorized by us
- Upload content that is illegal, defamatory, obscene, or infringes on intellectual property rights
- Manipulate ratings, reviews, or check-in data for personal gain
Violations may result in content removal, account suspension, or referral to law enforcement where appropriate.
Intellectual Property
The Open Play Finder name, logo, design, software, and all original content created by us (excluding User Content) are owned by or licensed to Open Play Finder and are protected by applicable intellectual property laws.
You may not copy, reproduce, distribute, or create derivative works from any part of the Platform without our express written permission, except as permitted by applicable law.
If you believe any content on the Platform infringes your intellectual property rights, please contact us at legal@openplayfinder.com with a detailed description of the alleged infringement.
Privacy & Data
Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy explains how we collect, use, and protect your personal information, including location data, profile information, and usage activity.
By creating an account and using the Platform, you consent to the collection and use of your information as described in the Privacy Policy.
Third-Party Links & Services
The Platform may contain links to third-party websites, apps, or services (such as payment processors, map providers, or advertising partners). These links are provided for convenience only.
We do not control and are not responsible for the content, privacy practices, or terms of any third-party services. Your use of third-party services is at your own risk and subject to those services' own terms and privacy policies.
Payment processing for event organizers is handled by Stripe. Your payment information is processed directly by Stripe under their terms of service and is never stored by Open Play Finder.
Disclaimers
Platform provided "as is." The Platform is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
No guarantee of accuracy. We do not warrant that court information, availability data, user reviews, or any other content on the Platform is accurate, complete, or current.
Physical activity disclaimer. Pickleball is a physical sport that carries inherent risks of injury. Nothing on the Platform constitutes medical, fitness, or safety advice. You participate in any activity discovered through the Platform at your own risk.
No endorsement. The listing of coaches, clubs, events, or facilities on the Platform does not constitute an endorsement or recommendation by Open Play Finder.
Limitation of Liability
To the maximum extent permitted by applicable law, Open Play Finder and its officers, employees, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform.
This includes but is not limited to: damages for loss of data, loss of profits, personal injury, property damage, or any harm resulting from reliance on court information, player matchmaking, or event listings found on the Platform.
In no event shall our total liability to you exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) one hundred dollars (USD $100).
Indemnification
You agree to indemnify, defend, and hold harmless Open Play Finder and its officers, employees, partners, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:
- Your access to or use of the Platform
- Your User Content
- Your violation of these Terms
- Your violation of any third-party rights
Termination
We may suspend or terminate your access to the Platform at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
You may delete your account at any time by visiting your account settings or contacting us at support@openplayfinder.com. Upon account deletion, your personal profile will be removed; however, anonymized community contributions (such as court data and aggregate check-in activity) may be retained to maintain the integrity of the Platform.
Provisions of these Terms that by their nature should survive termination shall survive, including ownership, disclaimers, limitation of liability, and indemnification.
Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top of this page. For significant changes, we will provide additional notice, such as an in-app notification or email to registered users.
Your continued use of the Platform after any changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Platform.
Governing Law & Disputes
These Terms shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms or your use of the Platform shall first be subject to good-faith negotiation between the parties. If negotiation fails, disputes shall be resolved through binding arbitration in Clark County, Nevada, in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction.
You agree to resolve disputes with us individually and not as part of any class action or representative proceeding.
